GENERAL CONDITIONS OF SALE
1) Introduction
- 1.1 These General Conditions govern every phase of the online sale between the agricultural company Tenuta Viglione di Zullo Giovanni, with registered office in Santeramo in Colle (BA) at Via Carlo Marx n. 44/P VAT no. 05599730727 E-mail info@tenutaviglione.com – pec: tenutaviglione@pec.it hereinafter “SELLER” and the user/customer (hereinafter “customer” or “consumer”) who places an order through the e-commerce site www.tenutaviglione.com (hereinafter site)
- 1.2 By placing an order on the Site, the user fully accepts these General Conditions of Sale.
- 1.3 The User is required to carefully read the Conditions of Sale before placing an online order.
- 1.4 Mandatory clauses pursuant to Legislative Decree 206/2005 (Consumer Code), Legislative Decree 70/2003 (E-commerce Directive), and Regulation (EU) 2018/302.
2) Definitions

Product: the goods offered by the Seller on the Site;

Customer: a natural person of legal age, with legal capacity, or a legal person in possession of the legal requirements, who places an order;

Sales Contract: concluded when the Seller accepts the Customer's order by sending the Order Confirmation;

Order Confirmation: automatic email/sent by system/seller that receives the order and indicates the order processing times.
3) Object of the contract
- 3.1 The object of this contract is the sale of movable goods offered via the website www.tenutaviglione.com .
- 3.2 The main characteristics of the products are illustrated in each of the product sheets;
- 3.3 The product sheets contain: photos, descriptions, technical characteristics, materials, colours, etc.
4) Registration and conclusion of the contract
- 4.1 Creating an account on the website www.tenutaviglione.com is free.
- 4.2 This can occur by registering on the Site and accepting the “Terms of Use of the Site”;
- 4.3 Alternatively, the purchase can be made as a guest;
- 4.4 Already registered users can log in with their credentials;
- 4.5 To create an account you must fill out a form with the required personal data and click on “Register”;
- 4.6 To verify the minimum age required by law, it is necessary to enter the tax code;
- 4.7 The creation of the account allows the Customer access to dedicated services and management of their data;
- 4.8 The Customer guarantees the truthfulness and completeness of the data provided; he is responsible for the conservation of the credentials;
- 4.9 The Seller may refuse abnormal registrations or orders at its own discretion;
- 4.10 The Customer can cancel his/her registration by sending a communication to info@tenutaviglione.com ;
- 4.11 The contract is concluded online via the site;
- 4.12 Pursuant to Legislative Decree 70/2003:
- a) The Buyer must complete an electronic order and transmit it to the Supplier;
- b) The Supplier sends an email confirming and summarizing the order as indicated in point 4.18;
- c) The Buyer may correct any errors prior to transmission;
- d) After transmission, the order can be modified up until its final processing;
- 4.13 The language for concluding the contract is Italian;
- 4.14 The contract is governed by the legislation on electronic commerce and consumption;
- 4.15 The procedure involves completing an online form and viewing the summary page;
- 4.16 The Seller may refuse or cancel orders at its sole discretion;
- 4.17 The order is archived within the terms of the law and can be consulted in the "My orders" section;
- 4.18 The Seller sends a confirmation and summary email;
- 4.19 The contract is concluded only with the sending of the aforementioned email;
- 4.20 The Customer must verify the data contained in the order confirmation and communicate any corrections within 24 hours;
- 4.21 The order number must be used for all communications with the Seller.
5) Payment Methods
- 5.1 Prices are in Euros, VAT included, unless otherwise indicated;
- 5.2 Shipping costs are calculated at the time of conclusion of the Order;
- 5.3 Prices may be changed without notice, but not for orders already confirmed;
- 5.4 In case of price changes after the Order, the Customer can accept or refuse the change;
- 5.5 Acceptance of the change must take place within 7 days via email;
- 5.6 Payment methods:
- Credit/debit card (Visa, Mastercard, Maestro);
- PayPal, Apple Pay;
- Advance bank transfer.
- 5.7 Payment by credit card is charged at the time of conclusion of the Order;
- 5.8 The bank transfer must be made with the details provided, the order will be processed only after crediting;
- 5.9 Financial data are managed by the payment circuits and the authorised credit institution.
6) Shipping and delivery of products
- 6.1 The products are delivered using the methods chosen or indicated on the site;
- 6.2 Delivery times vary from 1 to 30 working days;
- 6.3 In case of delays, notification will be given via email;
- 6.4 The Seller is not responsible for delays caused by couriers or exceptional events;
- 6.5 The Customer must ensure presence at the time of delivery or collect the shipment within the expected times;
- 6.6 For deliveries outside the national territory, taxes and duties are the responsibility of the Customer;
- 6.7 Any damage or discrepancies must be reported immediately to the courier;
- 6.8 Complaints about products received must be communicated within 8 days of delivery.
7) Right of withdrawal
- 7.1 The Customer may withdraw within 14 days of receiving the product by sending a communication to tenutaviglione@pec.it ;
- 7.2 The product must be returned intact, with original packaging and accessories, at the Customer's expense;
- 7.3 The refund will be made within 14 days of receipt of the goods;
- 7.4 In case of partial return the refund will be proportionate;
- 7.5 No refunds will be made prior to receipt of the goods or proof of shipment;
- 7.6 Exceptions to withdrawal:
- A) Personalized goods;
- B) Sealed goods not suitable for return for hygiene reasons, if opened.
8) Defects, warranty and liability
- 8.1 The Customer has the right to the legal guarantee for obvious defects, non-conformity or serious deterioration;
- 8.2 The following are excluded from the guarantee:
- a) Changes due to natural aging;
- b) Subjective perceptions not attributable to objective defects;
- c) Opened or consumed products;
- d) Incorrect storage.
- 8.3 Complaints must be submitted within 2 months of discovery and in any case within 24 months of purchase, via PEC;
- 8.4 The Seller may request the return of the defective product for verification;
- 8.5 In case of a confirmed defect:
- The Customer can request a refund or replacement;
- Shipping costs will be borne by the Seller;
- In case of out of stock products a similar product may be offered.
- 8.6 The Seller is not responsible for improper use or poor storage;
- 8.7 The Seller is not liable for indirect damages or loss of profits.
9) Protection of personal data
- 9.1 Data processing complies with the GDPR (EU 2016/679);
- 9.2 Purpose:
- a) Order and shipping management;
- b) Billing and assistance;
- c) Sending communications and promotions.
- 9.3 The Customer's rights may be exercised by writing to tenutaviglione@pec.it ;
10) Intellectual property
All content on this site is protected by copyright and industrial property rights. Unauthorized use is prohibited.
11) Applicable law and competent court
The contract is governed by Italian law. Competent court:
- Consumers: place of residence;
- Professionals: exclusive court of Bari.
12) Changes to the conditions
The Seller may modify the conditions at any time. The modifications take effect from the publication on the site.
